Terms of Use

Better Handled is a request and response delivery service. We do not perform, supervise, price, negotiate, guarantee, or contract for service work.

These Terms govern SanDiegoHandled.com and related services operated by DAWZO LLC, doing business as Better Handled (“Better Handled,” “we,” “us,” or “our”). By submitting a request or using the service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the service.

1. Eligibility and acceptable use

You must be at least 18 and legally able to agree. Submit only truthful, lawful requests for property or services you are authorized to request. You may not submit fraudulent, misleading, abusive, discriminatory, dangerous, infringing, or illegal content; impersonate another person; interfere with the site; or use responses or business information for scraping, resale, solicitation, or an unrelated purpose.

2. Our limited role

Better Handled collects customer-supplied request information, identifies independent businesses, invites them to respond, and transmits completed responses. We are not a contractor, home-improvement salesperson, employer, partner, broker, inspector, insurer, or agent of any customer or business. No business is “our contractor,” and no business may bind us.

Each business independently prepares and controls its scope, price, assumptions, exclusions, availability, inspection terms, and other content. We do not recommend or rank responses or determine which is best. A response is information from the named business, not an offer or guarantee by Better Handled.

3. No response guarantee

We do not guarantee that any business—or exactly three businesses—will respond, that a response will arrive by a particular time, or that a business will remain available. We may decline, suspend, or close requests we cannot safely, lawfully, or reasonably process.

4. Your responsibility

You alone decide whether to contact or hire a business. Before hiring, independently confirm its current license and classification, insurance, identity, references, scope, price, permits, written contract, required notices, cancellation rights, warranties, and suitability. Our checks reflect information available when reviewed and can change; factual screening is not certification or a guarantee of future performance.

Your descriptions, files, measurements, and site conditions affect responses. Prices and timing may change if information is incomplete, inaccurate, or different onsite. An estimate is not necessarily a final price. Any inspection fee, refund, or credit is offered and handled by the business unless expressly stated otherwise.

5. Direct business relationship

Any communication, inspection, agreement, payment, deposit, cancellation, warranty, dispute, injury, damage, or work arrangement is solely between you and the selected business. Better Handled is not a party and does not collect project payments, supervise work, resolve job-site disputes, or enforce a proposal, contract, warranty, refund, or credit.

6. Uploaded content

You retain ownership of submitted content. You grant Better Handled a limited, nonexclusive, royalty-free license to receive, store, copy, convert, resize, and transmit it only as reasonably necessary to operate the service, obtain responses, keep records, prevent abuse, and comply with law. You represent that you have permission to submit and share it. Do not upload sensitive identification, financial, medical, security, intimate, or unlawful material.

7. Privacy and communications

Our data practices are in the Privacy Policy. By submitting, you authorize request-related email including confirmations, questions, responses, and service notices. This is not consent to unrelated marketing.

8. Emergencies

Better Handled is not an emergency service and does not monitor requests continuously. Do not use it for gas leaks, fire, flooding, exposed electrical danger, medical or security emergencies, immediate lockout danger, active crime, or matters requiring emergency responders or a utility. Contact 911 or the appropriate authority.

9. Disclaimers

To the fullest extent permitted by law, the site and service are provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant uninterrupted operation; accuracy of user content; business availability; price, workmanship, safety, legality, code compliance, permits, timeliness, or results; or that screening will identify every issue.

10. Limitation of liability

To the fullest extent permitted by law, Better Handled and DAWZO LLC will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, lost profits, data, or use, or damages arising from a customer-business relationship or services performed or not performed. Our aggregate liability will not exceed the greater of $100 or the amount you paid Better Handled for the customer service giving rise to the claim during the preceding 12 months. Nothing excludes liability that cannot legally be excluded.

11. Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless DAWZO LLC and Better Handled from third-party claims and reasonable costs arising from your unlawful use, submitted content, violation of another person’s rights, or breach of these Terms. This does not require indemnification for our own unlawful conduct where prohibited.

12. Suspension

We may reject content or restrict access when reasonably necessary for safety, service integrity, or legal compliance. Provisions that by their nature should survive will survive termination.

13. California law and disputes

California law governs. Court proceedings must be brought in a court with jurisdiction in San Diego County, California. Before filing, each party will send written notice and make a good-faith effort to resolve the dispute for 30 days. This does not prevent an eligible small-claims action or urgent injunctive relief.

14. Changes and contact

We may update these Terms by posting a revised effective date; material changes apply prospectively. If a provision is unenforceable, the remainder stays effective. Questions and legal notices: requests@sandiegohandled.com.
